Non-Surrogacy Friendly States
Unfortunately, there are states that do not permit and, in some cases, prohibit the practice of gestational surrogacy. Certain aspects of gestational surrogacy are against the law or heavily restricted. Those who practice this may be fined, subjected to criminal charges, and even be imprisoned. Keep in mind that these states’ surrogacy laws have changed significantly over the last few years and are slowly converting into surrogacy-friendly states. Such is the case with New York. By 2021, there will be an amendment in the New York Surrogacy Law, and gestational surrogacy will be permitted.
The Neutral Surrogacy States
There are some states that though they might be considered friendly, there are many legal proceedings that have to take place. Though gestational surrogacy is practiced in the state, many of the contracts drawn up for this process would be unenforceable. The following states are considered less surrogacy friendly:
